I'd say new commissioner before new owner. Kraft has many supporters within the league of owners. Goodell goes before Kraft.

Since Goodell works for the owners, yes.

My suspicion is there are a few owners who are pulling the strings behind Goodell and Vincent. Irsay, Woody, to name a couple.

I just want to make sure I understand how the NFL disciinary process world.

Goodell could issue literally whatever penalty he wants - say, five straight first round draft picks - and there's nothig a team can do about it?

Before we say, no commissioner would ecer issue a penalty so far out of whack, I bring you exhibit A - four games for the starting QB who didn't even do anything, a million bucks, and a first and fourth round draft picks for an infraction that the rule book calls for a penalty of $25,000, and for which another team was actually caught on video violating with ZERO penalty whatsoever.

Do I get this straight? Is this really how it works?

And those 2 aren't big guns in the NFL. I bet Jerry Jones, Jeffry Lurie, John Mara all have Krafts back.

100% of the time.  Kraft is not going anywhere, he much more valuable to the other owners in the money making department

Smaller market owners should be concerned about any disunity among the owners. The league works in places like Green Bay bc big market owners are willing to share.

Turns out the Jets, Dolphins, Bills, Steelers, Ravens, and Colts - the fucking Colts! - all accepted payment from the U.S. government to honor soldiers during home games. And you thought the did it out of the goodness in their heart...

I think yecul is a lot more right than wrong. It's clear that the league is torqued off by the Pats unwillingness to comply with the investigation. BB for a long time has been the face of that uncooperative brand.

Understand that Goodell raped Bob Kraft. The statement from Vincent was as bad as it could possibly be. The only bone tossed Kraft's way was the exoneration of BB.

The Spygate prong of this ruling, though legally understandable, was a gratuitous kick to the nuts after the rape. It probably was not necessary to sustain the ounishment imposed.

Kraft damn well knows what his legal options are. It would have been derelict not to get that advice weeks if not months ago.

Both the team and Brady punishments are bonkers. I was expecting a one game suspension and some fines (which still would have been far more than the alleged infraction deserved, but Ginger Hammer gonna Hammer).

This makes me feel like Goodell went so hard specifically so he could take the appeal hearing and then try to appear magnanimous by reducing it down to a game and lesser fines.

And as a Bronco fan, all this makes me feel is Goodell is a menace and it could be my team next.

For those wondering about the procedure, here is the collective bargaining agreement.  I believe this falls under Article 46 (Commissioner Discipline), but could be wrong about that.  It's pretty straightforward.  Starts on page 204 of this link.
 
Brady or the NFLPA have 3 days to appeal.  The NFL and the NFLPA jointly select two hearing officers each year, and one will be assigned to the case.  The Commissioner, however, may elect to hear the appeal himself.  
 
The hearing must be held within 10 days of the appeal, unless the parties agree to longer.  If they can't agree -- in other words, if the NFL or Brady wanted to press for a quick hearing -- the arbitrator is the only one who can extend the deadlines upon motion.  There does not appear to be discovery, except that each party may submit exhibits 3 days before the hearing, and you're barred from relying on an exhibit if you don't produce it in that time.  Post-hearing briefs of up to 5 pages each are permitted but only if the parties agree. The arbitrator's decision is final -- he or she can affirm, modify or vacate the suspension but cannot increase it.  ("Finality" in this sense is tempered by the fact that there are some situations in which a court can review an arbitration decision, but those grounds are narrow and the arbitration decision is given great deference.)

NFL HQ wanted to drill the Pats. They got the pre-game complaint from the Colts and ran with it as a sting. You really think 2 alternate officials couldn't measure all of the Colts' balls? The big pile of leaks? You think Wells didn't get directions for the investigation? The "unwillingness to cooperate" stuff is just crap to scale up the penalties.

But another storyline I found interesting was what, inside the letter that league executive vice president Troy Vincent wrote to the Patriots, was actually being said to the other 31 teams in the league. The crushing harshness contained this message to the rest of the NFL that Goodell wanted to send: We do not play favorites.

Wrote Vincent to the Patriots: “The key consideration in any case like this is that the playing rules exist for a reason, and all clubs are entitled to expect that the playing rules will be followed by participating teams. Violations that diminish the league’s reputation for integrity and fair play cannot be excused simply because the precise impact on the final score cannot be determined.”

A quick poll of three officials of other clubs in the hours after the ruling found a mixed reaction. One top club official thought the penalty was excessive because there was no definitive proof in the Wells report that Brady either authorized the deflation of footballs or knew precisely that they had been deflated. Another said he was heartened to see the league treat the Patriots with an iron fist, though Kraft has been a close confidant of Goodell. A third said he and others in his organization were surprised by the severity of the punishment. “Way over the top,” he said. “Draconian. I thought the league went too far.” There was a no-joy-in-Mudville tone with these officials. Two of them said virtually the same thing—that this was a sad day for football.

Kraft plainly believes he has been double-crossed, violated and made a fool of. This ought to be good.

Let's see. That is implied from the statement, but doing so also means he's potentially killing his billion dollar golden goose. It will be interesting to watch. It would appear we are fighting an uphill battle with the draft picks and fine.

In our hearts I know we all want him to fight this (ok, except for Felger who wants the Pats to "come clean" whatever that means). And his statement indicates that Kraft might fight this (tho Ian Rappaport says he will still comply with the penalty).

But what recourse does Kraft actually have here? Put aside the whole "Kraft is going to get Goodell fired" angle. What steps can he actually take in defiance of this? What would he be willing to do?
