#DFG: Canceling the Noise

Is there any level of suspension that you would advise Tom to accept?

The Fox News comparison to ESPN may be apt. But at least in 2012, Miss Kelly tore into Karl Rove and took none of his wish casting.

Who, if anyone, is playing the role of grown up at ESPN today?

With all the uncertainty surrounding an appeal by the NFL, I hope that Brady considers settling this to put it all behind him once and for all.

Conditioned on Goodell accepting the findings of Berman's decision, of course.

This.

I don't think Goodell cares one whit about the decision other than it got a bunch of owners off his back.  In fact, given the numerous "errors" that were made - and the fact that the NFL could have avoided this by settling for a one-game suspension - it is almost as if Goodell wanted to be overturned, because it's not really him being overturned but all of the other owners who wanted Brady's head being overturned.

What the NFL wanted was a ruling that Goodell could basically set the rules as he see fit.

What the NFL could live with is being overturned for notice/process reasons - things they can fix if they really need to.

What the NFL couldn't have was a ruling based on evident partiality.

I think the NFL is okay with the decision.

I would love to someone print out the ruling and get Brady/Kessler to autograph it.

Just a small note:  a question was raised in one of these threads whether PW had a potential ethics issue; I read below to hint at the Judge having the same question.

p. 37: "Compounding Brady's prejudice is the fact that, as noted, Paul, Weiss acted as both alleged "independent" counsel during the Investigation and also (perhaps inconsistently) as retained counsel to the NFL during the arbitration. 21"

Denied the opportunity to examine Pash at the arbitral hearing, Brady was prejudiced. He

was foreclosed from exploring, among other things, whether the Pash!Wells Investigation was

truly "independent," and how and why the NFL' s General Counsel came to edit a supposedly

independent investigation report.

This is great, because it assumes the fiction that if Goodell *had* allowed Pash to testify, that Goodell might have found that the investigation was garbage.  Which of course, he'd never do, but also of course, Goodell can't say that.

Jesus Christ, there's only one person hurting the integrity of the game, asshole, and his name isn't Tom.

ESPN showing multiple tweets from players who are happy with the ruling and want to move on to football. Even James Harrison!

Yes, it is probably more support of the NFLPA rather than Brady himself.

They've both been quietly walking back their initial DG talk, just like they've been quietly walking back their "Trade Betts for Hamels" talk.

Becoming clearer to me that Pash was likely responsible for "at least generally aware" as the best that could be squeezed out of Wells. That would have been interesting testimony.

I wish there was a vehicle to investigate the NFL's conduct in this matter, specifically Kensil, the Colts, the leaks, etcetera.

There's nothing in that opinion that gives the Pats ground to get the picks back.   If anything, Berman's reliance on Brady's lack of notice on equipment violation penalties, because the notice was to teams and personnel but not players, gives Goodell another leg to stand on.

They ain't coming back.

That statement from Goodell is very good as such statements go. They obviously won't be seeking a stay, which would be idiotic. It also flags to me that they probably won't move to expedite the appeal -- there is no basis for that, it would fuck with the season if successful, and it would appear vengeful.

So this will probably to on the back burner to join the AP case on appeal. You hear nothing about that. I think we're clear of this for at least 9 months.

I just love the fact that Berman didn't fall for even a single ounce of the league's bullshit. The league coming back months later and saying "neener-neener none of this has to be independent, so there!" was so damn slimy.

I stand by my prediction that the NFL just quietly withdraws the appeal in about 6 months when nobody, truly, cares anymore.

They are saving face.

PFT: "The Patriots should print out the ruling, roll it up in a ball, and have Gronk spike it."

Sounds perfect for a pre-banner-raising ceremony.

He'll get some quality garbage time once Brady's arm gets tired from throwing so many TD's.

Other note:  Berman left open evident partiality, so even if NFL wins the appeal they go back to Berman on the remaining issues.  And they have a potential risk of having to disclose the Wells notes and communications to Pash, unless they get 2nd circuit to help them there.

They certainly have to appeal, but it wouldn't surprise me if they have a very narrow appeal that is not really designed to succeed.

Mackie Mac on now- says she is very surprised. Didn't really admit she advised Brady to drop the whole thing and move on. Says Goodell and NFL got what they deserved.

Schlereth is mocking Goodell's statement about trying to "protect the integrity of the game" by pointing out that it's Goodell's own actions in these cases that has put the league's integrity into question

Before he started rambling incoherently, he was skewering Roger on the "integrity of the game" canard, correctly pointing out the lack of integrity throughout the process.

No, he was rambling on about how all the players in the NFL are victims and transitioned into how they're kids from troubled backgrounds, etc. You have to had heard the particular conversation.

Hell yeah.  That really needs to be message #1 coming out of this.
