Is there any level of suspension that you would advise Tom to accept?

I guess I am confused, nay baffled, at the reasons why the NFL wouldn't contract that work out to a third party who that performs air testing, i.e., just take it out of the teams' and NFL's hands altogether. The NFL just had their toddler creamed from playing in the street unsupervised and their answer to correct it seems to be letting the toddler play in the street unsupervised.

The answer to this is that ball pressure makes no fucking difference. The proof of this is that it didn't dawn on anyone in the NFL that air pressure in contained systems goes down with temperature. As in ever. As in not from the very beginnings of the league when they chose the air pressure range out of a hat (seriously, no one has any idea how the NFL came to the number 80 odd years ago, unlike Major League Baseball the NFL folks never documented the whys). It's not even an enforceable rule thanks to the fact that you have teams like Miami and Arizona playing outdoors in September and most of the north and midwest teams playing outdoors November-January.

The rational response to this new knowledge would be to say "You know what, this has obviously been going from the start, and it doesn't seem to have made a difference, so screw it" Alas the NFL is presently run by fucking idiots so they're doubling down on the stupidty.

Because it's always been a non-issue. Jeff Blake would have his ball boys to let air out of balls almost every game, on the sidelines, in full view of God, officials, and NFL. And no one cared.

Thursday night will be the ultimate FU night in sports history. I'd expect most non-Pats fans to not even be able to watch it.
Soccer "ultras" are generally scum, but Thursday is a situation in which an organized movement comprised of rabid fans would improve the atmosphere of the game a thousand fold. Chants involving Goodell's wife would likely be in order in that scenario.

I think it's borderline hysterical that Kraft's statement referred to the lawyers and not the Sheriff also.

I've been a defender of Kraft but there was no reason not to call out RG there or at least include him along with those doing his bidding.

He was exonerated. If I"m having a conversation about this idiocy with a handful of friends and family or any of you then I will recognize the nuances of the events including the legal case and the legal grounds on which Berman made his findings.  To anybody else on the planet I am going to refer to this as The Exoneration.  Most others don't know anything except "cheaters" and, now, "technicality" so they don't deserve to get a reasoned response from me (which they have no interest in anyway) nor do they deserve to get a rise out of me. So all they will get is that "the Judge exonerated Brady," and for a little spice I will add "and the Patriots."

Exactly.  Beyond that though, fuck those who say it's on a technicality.  It's not like he got of on some purely technical violation - like say, not getting mirandized while being caught in the act - it proves that the whole thing, including the act itself, was bullshit.  When the entire process is proven to be biased and faulty, that invalidates the entire case.  Brady doesn't need to be found "not guilty" when the court he's being tried in is a complete sham.

I hate to keep saying this, but didn't the team lose a first round pick seven years ago and go to two SBs since then, winning one?  Dagger to the forearm perhaps, but not a death penalty by any means.

True but when this theoretical draft pick would have been entering his prime during the 2017-2019 seasons, when Brady will most likely be well into this decline phase.  A harsh truth.

Ladies and germs, Lester Munson:

'The law that protects arbitrators' decisions from judicial interference is a fundamental principle of American labor law. Goodell, in contrast to his bungling of the Rice, Peterson and Bountygate investigations, led a process that produced a solid investigation. Goodell's 20-page decision was impressive in its analysis of the evidence and its application of the "conduct detrimental" clauses of the CBA and the standard player contract. It was a vast improvement over Goodell's phlegmatic and occasionally incoherent testimony in the Rice arbitrations. And Brady blundered badly when he refused to cooperate with the investigation and destroyed evidence.

Finally, it is easy to envision the league attorneys thinking: "We just had the wrong judge." If so, why not take the case to three different judges in the higher court and see what happens? It will not happen quickly, but this is an appeal the NFL can win.

As per the other thread, I have a hard time figuring out how Wells got himself into this situation.

I know that Ted Wells has this cult of personality around him, but this seems like a very odd comment considering what we now know.

Whatever he was in the past, Wells proved that he is a nothing more than a glorified bag man now.  He came through for Goodell in the Incognito investigation and he did here as well.  But his work was transparently flawed and it's quite obvious that whatever integrity he had has a price: $5 million.  (Minus fees to Exponent.)

Maybe it's even simpler and Wells simply never was as good as his reputation.

Absolutely, and it sucks to be without that pick.  But that pick could also be a jag or on IR before week 1.  No guarantees with low first round picks.  It's not like they had to declare one of their starting tackles a free agent.  It's a hit, but not a catastrophe.

The Patriots last 7 first round picks:

Jerod Mayo
Devin McCourty
Nate Solder
Chandler Jones
Dant'a Hightower
Dominique Easley
Malcolm Brown

As Brady ages, it becomes more important to rely on guys like these. No, it's not a "catastrophe", I didn't say it was. But to shrugs your shoulders as if it isn't a huge fucking deal because they overcame this once before in the throes of a HoF QB's career is asinine.

Look at the names up there. It's a big fucking deal.

While it's true Wells had a fool for a client, I agree with you. The man went on the record and defended the independence of the report when it was not independent. That says something about his lack of integrity.

Meh. It sucks, but whining about it for the next five years doesn't seem like much fun and this team has overcome worse many times.

So this is a great question.  Apparently the NFL won't allow him back to his old job, but IIRC he can still work for the Pats in some other capacity.  What do yall think -- Tom Brady's personal assistant?  Bodyguard?  Walmart-style greeter?

Yup.   I just mentally imagine the 1st round pick blowing out a knee in training camp first year and never getting it back together.

It helps some.

So does Brady strap on the helmet tonight take the first snap and hand it off then walk off the field to the loudest ovation in pre-season history?

Seems anti-Belichick but something Kraft would love to see happen.

The pick loss is a farce, but the picks are gone. It sucks. It obviously matters, but there's zero anyone can do about it. After spending countless hours dealing with this joke of an issue for the last eight months, Im personally choosing to be happy today that some semblance of sanity has entered the process and that Brady is going to be there opening night when he deserves and be eligible for all 16 games this year rather than dwelling on not having a '16 first rounder.

I see no problem with it. Get him in there for a handoff and then put in Lindley.

Here's the lede:

Have the National Football League’s lawyers gotten their appeal filed yet, or were they too busy applying the league’s concussion protocol to Roger Goodell, who got his bell rung good and proper by Judge Richard Berman on Thursday morning? I’m serious about this. If somebody asks him how many fingers he sees, and he answers, “Article 46 of the collective bargaining agreement,” they should sideline him immediately.

My immediate response when I heard the news was "Suck it, Trebek".  I'm still pissed about the draft picks.  I agree that they are gone.  In my fantasy world people start asking the question: if the suspension is overturned why do they lose the picks.  This gets picked up by the media and eventually the picks are restored.  I know it's a fantasy, Goddell is too stubborn and obviously thinks he can still win this thing.  I just like to wish sometimes.

The picks were gone the very minute after Kensil leaked misinformation to Mort that Goodell decided to double down on it rather than telling ESPNFL to recant the story. The only possible saving grace for the Patriots, from that moment forward, was to get out of this with their head coach and their QB not being suspended. Yes, Goodell is a vindictive idiot that will continue this honky ass bullshit until his contract comes up for renewal or until the next major screw up.

Kessler:  Not surprised by the decision, they had a strong case.  This is a win for all NFL players because it establishes that the commissioner is not above the law.  Cites lack of notice, fundamentally unfair proceedings at arbitration as the two key issues.  The NFL needs to take a lesson from the other leagues and create a fair disciplinary process with an independent party.

The folks who were advising Brady to accept some form of punishment and 'get it over with' are like the schlubs on 'Deal or No Deal' who would panic after having a few cases going against them and accept a $30,000 offer, only to watch the hot babe open up their case and see '$500,000' or '$750,000'.
