Don't freak out if/when the judges go after Kessler just as hard. This is how Appeals Court works.

This is the most obvious question to ask first and is one that Clement raised that the previous incompetents missed.

Kessler will probably say that either it applies and the fine should be $5K or it doesn't apply and there's no notice. Either way NFL is wrong.

Parker calls Brady "one of the most celebrated athletes in the game." But he suggests that this may argue in favor of punishment.

Why would being a celebrated athlete have to do with punishment? Either there was or wasn't a violation.
Guessing because the NFL has to show there aren't different rules for stars vs. non stars

I know you're playing devil's advocate but there aren't longer suspensions for PED violations by stars vs. non-stars. This should be the same.
Well it's kind of a first - ball deflation had never been "caught" before.

(Aside from the Minnesota game where it was actually ball inflation)

Eh I think Kessler can argue they gave all the email records, the phone logs, etc. to Wells et. al. and Wells' team was too lazy to dig deep

I think we were all in consensus that the people advising Brady to destroy his phone dropped the ball on that one. It gave the NFL their "We will never know because he destroyed the evidence!" moment.

This is a flat out non truth - the punishment specifically says it was in part due to non-cooperation.
That's what I recall too. Is Chin being provocative or really in the dark (relying on clerks) about the facts and evidence?

No, right in Troy Vincent's letter to Brady:

Moreover, the report documents your failure to cooperate fully and candidly with the investigation, including by refusing to produce any relevant electronic evidence (emails, texts, etc.) despite being offered extraordinary safeguards by the investigators to protect unrelated personal information, and by providing testimony that the report concludes was not plausible and contradicted by other evidence.

That seems strange. Isn't is obvious that Goodell's motivations are to force the court to rule on his absolute power to implement any punishment he wants through his role as arbitrator regardless of the specific rules and punishments outlined in the CBA?
