I'm trying to remember, because I was very, very young, but I believe his girlfriend (or fiancee, don't think they'd married yet) had one small child and was pregnant with another.  They were all super nice and appreciative and he played nerf football in the backyard with me.  Honestly, I hadn't realized he'd died.  Very sad.

Massachusetts State Police have issued a citation charging BRANDON V. SPIKES, 27, of Florida, with several motor vehicle offenses after determining that SPIKES was speeding and driving negligently when he crashed his 2011 Maybach sedan into the back of a sport utility vehicle on Route 495 northbound in Foxborough. The occupants of the SUV suffered minor injuries in the crash, which occurred early Sunday morning.
 
SPIKES will be summonsed to appear in Wrentham District Court, at a date yet to be determined, on the following charges:
1. Leaving the Scene of a Personal Injury Crash;
2. Operating a Motor Vehicle Negligently to Endanger;
3. Speeding; and
4. Failure to Stay Within Marked Lanes.
 
The crash caused minor injuries to a Billerica man and woman and their 12-year-old son, the occupants of the 2009 Nissan Murano, who were all transported to Sturdy Memorial Hospital in Attleboro. All were treated and released.
 
The charges against SPIKES are the result of a comprehensive investigation that determined that SPIKES’ Maybach was the car that struck the Murano and that SPIKES was driving the car at the time of the crash.
 
Responding troopers located the Maybach with significant front-end damage in the median off the northbound side of Route 495 shortly before 3:30 a.m. on June 7. The driver was not with the vehicle. Before he fled the scene, however, he was contacted by the Mercedes onboard assistance service, which had detected a crash and called the vehicle. During that call, the driver reported that he had struck a deer.
 
When troopers responded to the abandoned car, they found no evidence of a deer strike on or around the Maybach. Around the same time, also on Route 495 north in Foxborough, troopers responded to the Murano, which had pulled over into the breakdown lane. The vehicle showed evidence of being struck from behind.
 
The investigation was conducted by Troop H of the Massachusetts State Police, the State Police Collision Analysis and Reconstruction Section, and the State Police Crime Scene Services Section. No further information is being released at this time.

Although their lawyer wont admit it unless he's strapped to a chair with a needle, the civil suit against Spikes for rear-ending those folks isn't worth any more money simply because he fled the scene, no matter how "perplexing, astounding and inexplicable" such action may be.

Actually, it's the very sort of thing that could piss off a jury. No, the case isn't worth much if it only involves soft tissue injuries, but if there's anything serious, Spikes' assholery can give it some jury appeal. And I would assume that he has a decent-sized liability policy (of course, a guy who spends way too much on a car might just be dumb enough to skimp on the insurance. We are, after all, talking about a guy who scored a 13 on the wonderlich.)

It's worth more because he fled.
It's worth even more because he fled to avoid a DUI.
It's worth even more if those witnesses who tweeted he was hammered end up on the witness list.
Defense attorneys won't let that case near a courtroom. We'll never get the details but you won't have to set aside time out of your life to watch the Brandon Spikes trial.

No it isn't. I've tried dozens of these.
 
It probably will settle, or if the plaintiffs are being unreasonable, the defense will concede liability and have a damages trial. leaving the scene wont even be mentioned.
 
 
Its pretty easy for a plaintiff's lawyer to turn a $25,000 case into a $2500 case by arguing that its a $250,000 case.
 
Actually, it's the very sort of thing that could piss off a jury.
 
 
which is exactly the argument the defense lawyer makes to keep it out.

I understand what you're saying, but leaving the scene will be part of the settlement discussion in a case that is likely to settle. I don't know anything about Massachusetts auto liability, but I do know that if everything we've heard about this case is true, the concession of liability would not be limited to simple negligence, you've got facts for reckless, gross negligence, wanton and willful misconduct, etc., and I doubt you want to have a damages hearing where punitive damages is on the table (if you're the defense bar). 
 
But if you're the plaintiffs bar, which case would you rather have, this one or the garden variety rear end collision where passengers have soft tissue injuries?

If memory serves, punitive damages aren't available under MA law for personal injuries not resulting in death. So while I tend to agree with PMB that the "morality play" aspect of litigation is important, in this case Spikes might be able to keep his conduct out of the case by conceding liability.

Spikes pleads gulity to leaving scene of accident.  One year probation, a fine, and loss of license. So barely a slap on the wrist.

Well, the fact is that nobody got hurt. He's lucky, but I think it's a pretty fair sentence, given how it played out. People really do love their punishment these days.

See, this is why it's essential to leave if you think you would be busted for DUI. He would have gotten jail time for sure.
