Could also be Prescott getting in front of it. Both things could also be true. Seems like Dak got his PR in order before doing anything.

This part was pretty interesting to me: "The letter stated: 'Despite the tragic events, she is willing to forego pursuing criminal charges, along with disclosing this information to the public, in exchange for compensating her for the mental anguish she has suffered. (The alleged victim's) damages are valued at the sum of $100,000,000.00.'"

This would be unethical for a lawyer to do in many jurisdictions. Texas seems to follow the majority rule, but I have no idea if there are cases there that interpret it.

I always default to believing the victim
Alleged.

I've seen victims on both sides of this in my life. Celebrity throws the whole proposition into a realm I will never have full access into.

I try to assume I know nothing.

edit: that said, fuck Deshaun Watson and fuck Trevor Bauer into the sun (yes, I know that was a mixed metaphor, but I like it)

I always default to believing the victim, but them looking for (allegedly) $100m gives me a little pause. I won’t make a judgement now until more details are out.
Same here, plus the fact that it was seven years ago. On its own that means very little but the offer to let this go for 100m seems off.

If she's largely correct about what happened, and the only difference was that she had asked for $10M, do we think Dak would be going full PR campaign, or he would have just cut a check and been done with it? If the latter, then we've already established what he is, and we're just haggling over the price.

Hmmm, just heard a take on sports radio today that the Cowboys have been oddly quiet in free agency. I wonder if the organization was tipped off this was coming down the pike, and they are taking a "wait and see" position until they are clear their QB is set.

Can a lawyer walk be through what is extortion vs what's a settlement offer?

I clearly don't understand,
It is a fine line. If the threat of criminal prosecution comes up ancillary to a civil claim you are seeking to resolve, you are ok. A straight threat to abstain from making a criminal complaint to get paid is dicey. This usually arises in lawyer discipline. Prosecutions are rare. But the lawyer disciplinary rules are meant to track the law of extortion kind of.

I read Dak’s complaint, and the problem the lawyers have is they are alleged to have admitted that a civil claim is time barred. If true they are very stupid. They cannot possibly claim this was a threat ancillary to a good faith attempt to settle a civil claim.

Here is a write up of how this issue plays out in California, which addresses the question of where the line is. Note the discussion of the Flatley case, another 100 million dollar demand.

(Edit — none of this is meant to express any opinion on Dak’s conduct. Both things can be true. It could be extortion and assault.)

It could be possible, but it's more likely they have been quiet because they have no cap space. I'm sure like most teams they could create some but currently OTC has them at $2.2m

Yeah, this. They have less than $3M in cap space.

Oof, yeah I forgot how much they added last offseason (including Cooks and Gilmore) even after Zeke was out. Also, Zeke's dead cap number is slightly up from last season in 2024.

I think the Cowboys were expected to extend Dak to bring down his egregious 2024 cap number ($59.5M) and free up space for upgrades. Jerry Jones made intemperate comments earlier in the offseason about Dak, which I figured had complicated negotiations for an extension that seemed like a no-brainer for both sides. Now, of course, I wonder if these allegations were the real reason for the lack of an extension.

I immediately had the same thoughts when I read that line.
